opening day on labor day for the new eastern span. you are looking at a live picture from hayward where just about an hour ago, city workers launched a three-day strike. we'll have more on that story in a moment. good morning. i'm tori campbell. >> i'm dave clark. let's check your weather, traffic. steve, we're gonna have a lot of sunshine today? >> a lot of sunshine. we start off with fog. it's kind of parallel kind of hugging the coast with some moving inland. but these are the average highs this time of year. santa rosa, 83. 82 san jose, sfo, 73. oakland, 72. san francisco, 68. and then they are all above average here. first time in a long time. 71 san francisco. sfo, 73. 84 san jose, and santa rosa, sonoma county airport, 85. still a lot of low clouds on the coast. pretty solid there. but i think by this afternoon, it will be sunny to mostly

sunny. around the bay what's moved inland will burn off fast. fog or clear. not widespread. sunny, mild to warm later on. inland temperatures, any fog won't last. by 9:00 it's usually out of there. 50s on the temperatures. 60. but 50 san rafael. 48 in novato. most locations are in the 50s. santa rosa, starting off with some fog but then i think it will be out of there pretty fast. we'll go 72 and then that high of 80 degrees today. temperatures have been held in check by an area of low pressure. that's long gone. high pressure is now building in. so the fog really doesn't have a lot to last that much longer. but by the toast, it might take aing lower. fog, coast warmer. temperatures finally going over. that's how we get average. we've been below. now we're going above the bay. he's sal. steve, good morning. we're looking at the commute and some of the trouble spots and some of the busiest spots

right now, the bay bridge, although we're seeing some improvement here. you can tell it's cleared up from 6:30, which appears to be the peak. the metering light traffic appears to be getting through faster. also this morning on the san mateo bridge we're looking good. northbound 101 when you get to the peninsula looks good. a little bit of fog over there. that's on the high rise. northbound 101, sunnyvale, at mathilda avenue there's a report of a crash there. the fire department and the chp are on the way. 7:03. back to the desk. all right, thank you, sal. >> the strike began 60 minutes ago. hundreds of city workers in hayward have walked off the job for the start of a three-day strike. ktvu's tara moriarty joins us live to tell us what led up to today's walkout that's happening right there behind you. good morning, tara. >> reporter: well, good morning. that's right. in one hour replacement workers are supposed to slow up at city hall. we're not sure if there will be a confrontation. striking workers are walking here at the picket line.

now, the library is just around the corner here. we noticed that someone was trying to get in a door there, and they were not letting him in. members of local 1021 hit the picturette line after negotiations between the union and the city reached an impasse at the bargaining table. 280 workers are striking today outside of the city's animal control center, department of public works and libraries. they will do that for the next three days. workers have been without a contract since april and without a raise since 2010. they game the city. >> the problem is, they are not being truthful to us about what is in the budget. i want to be clear -- we're not here on an economic strike. we're here because they've refused categorically to negotiate with us. since february all they've said we want $5 more million- dollars. >> we have a $2.6 million deficit in our budget. that doesn't include the

unfunded for the retirement and basic needs. just to pay for bank needs we're in a deficit. that doesn't get us ahead in terms of funding or retirement obligations or fixing city streets. >> reporter: the city has filed state charges claiming this is an illegal strike. we have learned those who work in 911 dispatch will remain on the job during the strike. workers didn't want to put anyone's safety in jeopardy. they wanted to let the city know they mean business. live from hayward, tara moriarty, ktvu channel 2 news. and dozens of domestic workers are scheduled to rally outside of san francisco city hall. it's part of the national campaign, the domestic workers are calling countdown to dignity. domestic workers across the country are calling on the u.s. government to mandate better wages and benefit for in-home caregivers. the workers are also demanding regular rest periods and overtime pay. 7:05. a temporary fix for those bad bolts on the new bay bridge has

been approved. so will the new bridge be open soon? alex savidge is joining us live on treasure island to tell us about a plan that could make a labor day open a reality. good morning, alex. >> reporter: good morning, dave. no decision has been made to move up the opening for the new bay bridge. but certainly a labor day opening is not out of question, especially now since the federal highway administration has okayed a plan to temporarily fix the broken bolts. the work can get underway to install shims to shore up stabilizers on the bridge. a letter sent to the oversight committee, the federal highway administration says it reviewed the temporary fix and determined the plan to provide adequate seismic safety until a permanent fix can be completed in december. this could bode well for an earlier opening. back in early july, the bridge

oversight committee nixed a lanor day opening because of the faulty bolts and that was pushed back to december. another opening day for labor day could be a reality. according to a published report, the chp began to sign up employees for around the cloud cover overtime shifts for lane hoar day. a spokesperson told me that's simply a formality because the agency has to be prepared to do traffic control if the bridge does, in fact, ohm. meantime, later tonight, as you look live acthe new ac-- look live at the spann of the bay bridge, they will turn on the energy bolts and they will hold a public briefing. one of the big questions will be whether officials plan to move up the opening date for the new span of the bay bridge. we'll have to wait and see. alex savidge, ktvu channel 2 news. >> all right, alex. new this morning -- a traffic mess in dixon. a tomato truck flipped over

causing a slippery situation for drivers. this happened about 3:00 this morning. southbound interstate 80, quite a bess out there -- mess out there to clean up. still no word what caused the crash. today, the marin county coroner will perform and autopsy on a man from martinez who died on a hunting trip. he was with other hunters on saturday when a gun went off inside the car they were in. there are reports the gun fell from a rifle rack and went off. funeral services are set for a 16-year-old and his mother. the funeral service and memorial for the little boy is on friday. services are open to the public. the mother of drew jackson is asking people don't wear the color black. the funeral for boy's father, drew thomas, is one week from today. no arrests have been made. today, oakland police are expected to announce whether a

woman's body found in vacaville last friday is a missing oakland woman. sandra coke disappeared more than a week ago. she is an investigation with the federal defenders office. she was last seen with a man she had dated briefly 20 years ago hours before she disappeared. police have surveillance video of randy alana putting gas in coke's car. he is the convicted rapist and robber required to wear a gps device as part of his parole. but two days after coke vanished, the state corrections department issued a warrant for his arrest for failing to participate in the gps monitoring system. of the state is not saying when the gps stopped sending signals on his location. the man charged in this month's deadly stabbing of a hardware store worker is due in court this afternoon. the victim, daniel stone, was starting his shift at the store nine days ago, when someone walked in and stabbed him 17

times. damon agnew was later arrested for the killing. investigators says he's a mentally unstable man who claimed he was "on a mission from allah." well, this morning, bay area hospitals are being warned about a woman pretending to be a nurse. deputies say 29-year-old crystal cook was wearing scrubs and a stethoscope when arrested at santa clara valley medical center in san jose. she even had a fake i.d. hospital officials say cook would not have been able to get into critical areas like the emergency room because her badge was not a real key card. patients are calling for better security. >> i'm very worried because, you know, anything -- somebody could happen to a patient. and it's gonna be under her responsibility and they don't know what she did or did not do. >> deputies have not said why cook was impersonating a nurse but say her facebook postings led to her arrest. they say she has no medical background and there's no immediate evidence she actually

treated any patients. she has been released from custody. the driver of a party van involved in a deadly crash on the peninsula sunday night is facing criminal charges. officials say jason kinonez was driving the van that went off the road on 280 near portolo valley and slammed into a tree. he was booked into jail on suspicion of felony hit and run, dui and manslaughter. one of the passengers was killed in that crash. 7:11. livermore, long celebrated for its wayne is gaping a reputation as a new haven for beer. working man brewing company just opened in the east bay city and brotherhood brewing company is opening soon. the san francisco "chronicle" reports the first brewery altamont is overflowing with customers and first street ale house in downtown reportedly orders 50 kegs of beer a week. a new study says concerns

governor brown has signed the nation's first law that protects transgender students at school. the new law allows transgender students to use restrooms, locker rooms or even join sports teams based on the gender they identify with. supporters say the law will help transgender students who are bullied and make sure they get equal treatment at school. >> rather than singling out kids specifically who are transgender identified, this is a way for them to feel like they are just like their peers. they are treated exactly the same way. >> the law affects kindergarten through 12th grade and will take effect january 1st. 7:15. another setback for president obama's healthcare law this morning. the administration has delayed a mandate that protects consumers by limiting how much they have to spend on their own

healthcare. as kyla campbell reports from our washington, d.c. newsroom, republicans who are fighting the law are happy about this. kyla? >> reporter: dave, many republicans will use this as a discreditty law. the cap was going to be 6300 for an individual and just under 13,000 for a family. but the new york times reports the obama administration is delaying the mandate for a year until january of 2015. that means some insurers can set higher limits at all or no limits at all. the new york times says this delay has been outlined on a government website since february. but it went unnoticed by the legal language. health plan sponsors need to upgrade computer systems. congress might be on resers this month. but -- on recess this month. but senator rubio encouraged followers on twitter this morning to sign a petition to

"defund this disaster." this is the second obama care delay announced in just weeks. what the two could mean for patients when i see you next. live in washington, kyla campbell, ktvu channel 2 news. want to check in with sal, see how things are rolling at the bay bridge toll plaza. >> they are rolling. it looks like there's some improvement, westbound as you come into the city. the peak appears to be 630. we're seeing a lot better movement here and that usually leads to a clearing up before 9:00 unless something happens on the span of that upper deck. you can just tell by looking at the traffic flow here. of course, the metering lights did not affect the carpool lanes. those have been doing well all morning. northbound 101 looks good approaching the 80 split. no problems on 101 heading down to the international airport terny nal. if you are driving -- terminal. if you are driving in

sunnyvale, traffic slow. westbound 27 slow traffic approaching mountain view. today is better than normal here in the silicon valley trafficwise, so far, anyway. let's go to steve. >> thank you, sal. good morning. some fog there. definitely some breaks. it's kind of just hugging the coast. a band of it and then a little bit, pockets of it make it inland. but i mean there's a lot less today than we've had. temperatures yesterday actually got near average to slightly below. today they will be above. 80 in santa rosa. we'll go 85 today. 86 in concord. 90 today on a forecasted high. haven't had 90 in a long, long time. san francisco, also came within 1 degree -- within 1 yesterday of hitting 70. hadn't had that since july 4th. i think we'll see it today. there's a westerly breeze. but most locations are on the cool side. low 50s, mid-50s to upper 50s. there are upper 40s and lower

50s. you know 20 is usually a cooler pattern. anything under 10 is a warmer pattern. i did see a delta breeze around richmond out towards port chicago, about 10, 20. that's about it. otherwise, most areas say calm or less than 5. the system with the cool pattern, long gone. high pressure is following behind that. as it does, it chews up the fog. the temperatures come up today. fog, is up, warm -- fog, sun, warmer, morning clouds, not as nice as warm but the coast really 60s and 70s. its inland where the biggser jump will occur. clearlake, 96. cloerwy let's see if she buys that. 82 in petaluma. heard from bubba the tortoise. yeah, he checked in. he wants some sun.

86 in napa. 72 in richmond, vacaville, 95. antioch in there. low 90s, upper 90s for many east bay locations. san jose, 84. low 90s morgan hill and gilroy, fremont, 80. santa clara, 84. 60s on the coast. san mateo, 78. 84 woodside. 82 in mountain view. fog, sun, warm into thursday and then it looks like a cooldown system will move into the north on friday/saturday. looks like a warmer pattern on sunday. all right, steve. mosquitoes infected with west nile virus, they've been found in parts of san jose. so santa clara county officials plan to fog that area thursday. now, the fogging area is bordered by berryessa road, east san antonio street as well as north and south jackson street. in the meantime, a santa clara county woman is recovering after becoming the first person in the county to test positive for west nile virus this summer. there have been 14 confirmed

human cases around the state so far this year. two of the cases were fatal. 7:20. a 10-year-old martinez boy, seriously injured in a pit bull attack. what the parents are saying about the dog and the owner. and there's a new study suggesting a link between a common practice used in child birth and autism. the cautionary warning that's coming from researchers. look at 'em.

the american association journal pediatrics. researchers are cautioning this study is preliminary and say doctors should not delay giving labor induced medication which may be a life-saving case. well, cal football avery sebastian, recovering from a very hard tackle on the football field that led to him being carried away from practice in an ambulance. it happened yesterday. he didn't move for several minutes after tackling another player. cal says sebastian does have movement in all of his extremities. he's expected to be released from the hospital soon. 7:24. at an appearance in san francisco, u.s. attorney general eric holder proposed major changes in the sentences given to people convicted of minor drug offenses. speaking at a meeting of the american bar association, holder proposed scaling back mandatory minimum sentences for low-level, non-violent drug offense es. he says his proposal would ease

prison overcrowding and hopes it would also address racial disparities in prison. >> some of the enforcement priorities we've had have had a destabilizing effect on particular communities, largely poor and of color and applied inappropriately, they are ultimately counterproductive. >> he also called for new policies enabling sick or elderly inmates without a violent past to be releasedder early. former secretary of state, hillary clinton made an appearance at the bar association meeting in san francisco. she received a distinguished service award for her work as an attorney. in her remarks, clinton criticized the u.s. supreme court ruling that stripped parts of the voting rights act. she also said she would be making other policy speeches in the coming months, which, of course, has led to speculation she's preparing for another run for the white house in 2016.

7:25. the officials at the missouri state fair are apologizing after a rodeo clown appeared over the weekend wearing a president obama mask. now, that photo of the clown, it has gone viral on the internet. the person who posted it said he was offended, especially when the rodeo announcer asked the crowd if anyone wanted to see "obama run down by a bull." >> i understand people's concerns. i don't think anyone is more disappointed in what happened last night than we are. we take that very seriously. >> well, the missouri cowboys association says that act was not scripted and they didn't know anything about it. the missouri state fair has imposed a life-time ban on that rodeo clown. part of a former employee's lawsuit against paula deen is being thrown out. deen's former employee, lisa jackson, claims racial discrimination, sexual harassment, and abusive treatment. a judge ruled that jackson can't claim to be a victim of

racial discrimination because she's white but the other parts of her lawsuit, they still stand. paula deen has admitted using racial epithets in the past and has publicly apologized. a father speaks out about the sire just charges face -- serious charges facing his son. >> i seen the way he cared for himself two weeks after that. i didn't think he did it. >> why leila fowler's father says he does not believe his son killed his 8-year-old sister. and why smash-and-grab burglaries may be on the rise in silicon valley. good morning. right now, we have traffic getting busier in some areas but also improving in others. we'll tell you where. many mornings have started off with fog. today there's a lot more sunshine than fog. some of that is kind of holding on. we'll take a look at what warmer temperatures look like where you are.

we'll see the temperature climb. it's not one that's been climbing too high lately. it looks like it will get in the upper 60s to low sphents around 2:00, 3:00. fog, cool. but partly cloudy we'll say. cool, mild. it looks sunny for all. the fog is there. it's more parallel to the coast with some patchy low clouds in. 50s on the temperatures, 60s. the fog is coming down. high pressure is chewing up sooner. it's lost its support with low pressure. we'll go 50s, and 60s mor most of the coast. inland temperatures, 80s to near 90s. the farther inland locations will push to 90s for some. vacaville, clearlake, up to ukiah. low clouds, not really too much to help it along. there's a little bit of a westerly breeze. morning clouds, nice to warm, fog, sun, warmer for many. temperatures some low to mid-

90s. get closer to the bay. 70s and 80s. 85 santa rosa to san jose checking in at 84, low 90s. livermore, pleasonton, 80s on the peninsula. 60s, 70s on the coast. here's sal. we still have traffic that's busy around the bay area although we're seeing some signs of improvement around. this is 237. this has become busier in the last half-hour or so, driving over to to -- to a crowded mountain view. the valley um is done. in september, i suspect to see bigger packups. today we have a back up at the toll plaza. that's improved a little bit. it's still backed up for a 15, 20-minute delay. we're expecting unless there's something that -- something really bad happens on the bridge that we'll get some clearing after 8:30, in an hour or so. this is highway 4, still slow in antioch and also in baypoint. 680 is moderate as you head down from concord to walnut creek. back to the desk. all right, thank you, sal.

7:32. this morning, police in palo alto are warning drivers about a rash of smash-and-grab car burglaries. palo alto police say they've see responded to 70 car break- ins, almost 50 occurred in the month of june. many break-ins have been in the el camino area and near the sanford shopping center. police say drivers of rental cars should be especially careful. they say burglars often target those cars because people are more likely to leave valuables inside. the red cross is helping 25 people out of their homes hafer an early-morning apartment fire in santa rosa. the fire started at 1:00 a.m. at the marlow apartments. it took an hour to put it out. three apartments had heavy damage. several others had minor damage. no one was hurt. it's confirmed. a woman's body found saturday in sequoia park is that of a

san rafael woman. 65-year-old johnny jean daniel disappeared last week during ak -- during last week. a 4th grader attacked by a pit bull is due to have more surgery later today. 10-year-old hunter kilborn of martinez is recovering from major injuries suffered in the attack. the little boy was visiting family/friends in antioch sunday morning when a pit bull got into the house, jumped on him and repeatedly bit his cheek, heads and arms. doctors had to reattach his ear. the little boy's mother is little angry. >> that's negligence knowing it's a vicious dog and you don't do anything about it. >> the pit bull was taken away by animal control officers.

it will be quarantined for at least a week. the little boy's mother is determined to make sure that dog is put down. the father of a 12-year-old boy accused of killing his 8- year-old sister says he does not believe his son committed the crime. >> i turned isaiah in. most people don't know that. that was hard enough. >> the 12-year-old has pled not guilty to charges he stabbed his sister, leila, to death at their calaveras county home. police say the boy tried to blame the death on an intruder and that caused a panic in the town of valley springs. fowlerrary says he does not -- fowler says he does not know how leila was killed but does not believe his son is responsible. >> at the beginning we were cooperating, doing all of the interviews, we met them every time they wanted us to. we would stop what we were doing and talk to them.

and then they no longer talked to us when isaiah became a suspect. protesters who have camped outside of the historic post office in berkeley are getting good news. it's been given a reprieve but it may be brief. brian flores has more. >> reporter: they've been camped out here since late last month. they say the news that the building will be spared for right now is definitely good news. they say it's a small victory but they are not exactly celebrating just yet. many got notices last week. they handed out notices that they would have to leave or possibly be arrested. well, the group stayed. now they are hearing that the historic post office is being spared for now. late last week, the u.s. postal regulatory commission agreed to hear tom beats bates.

the plan was to sell the building and then rent space for postal services but the building that's been here since 1914 will be spared a few months until the mayor speaks in front of the commission in september or october. some members of the group say they are happy but still skeptical. >> the people of berkeley, the community, and this is what we want. this is -- we want this here. this is all we got. >> reporter: after the hearing, the commission would have 120 days to grant or deny the appeal. we spoke to some members of the group this morning and they say they are planning on staying until an actual decision is made. we're live in berkeley, brian flores, ktvu channel 2 news. >> all right, brian. 7:37. a 17-year-old who survived a san jose car crash saturday night that killed two of his best friends, he's talking now about what caused the accident. >> i grew up with them.

it won't be the same. >> paul lopez says he believes the driver of the car may have swerved to avoid a second car before losing control and slamming into a tree. police believe it was a single car crash and say the driver was speeding and under the influence. lopez admits they had been drinking. >> don't drink and drive because you never know what can happen. >> lopez has a broken leg. he's expected to survive. two other people in the car were critically hurt but the driver and another passenger were killed. 7:38. a wildfire clouding much of placer county with smoke has spread to 1200 acres now and it's still burning. the american fire started on saturday near forest hill. it's grown 400 acres since this time yesterday. smoke from the fire will be settling in forest hill, auburn, nevada city and the

surrounding valley for the next few days. the fire is burning in very steep terrain and is being fought mainly by aircraft. two large wildfires are burning right now in central idaho. the elk complex fire near pine, idaho has charred more than 90,000 acres. so far, it's just 5% contained. there are mandatory evacuations, but some people are still refusing to leave. further south, the fire spans 144,000 acres and is 30% contained. fire officials say lightning started both fires last thursday. a camp host from richmond has died after falling over a 100-foot waterfall in the sierra. it happened saturday near the farm meadow campground in madera county. daniel greenlaw was directing a group of sierra vacationers to a swimming hall when he slipped on rocks and fell over the waterfall to his death. a search team found his body on

sunday. east palo alto residents, you will soon have to find a new place to park. the palo alto city council banned overnight parking in parts of the crescent park neighborhood for one year. neighbors say that ban is needed because people who live in east palo alto are using their streets for parking. enforcement is expected to start next month after signs about the ban have gone up. a bay area state senator wants to crack down on doctors who they say wreck alsoley prescribe oxy contain. one senator is demanding the names of california doctors who prescribe that painkiller to drug dealers and drug addicts. he and other southern california state senators says the drugmaker has a list of 1800 doctors around the country who show signs of dangerous prescribing. only 154 names have been turned over to the police. and cbs drugstores have a new -- cvs drugstores have a

tragedy last night at a major league baseball game. our reporter is live in atlanta to tell us what the police are saying after a fan fell 65 feet is dead. >> reporter: the medical examiner's office has identified that fan as 29-year- old ronald holmer. police say are saying -- are saying there's no indication of foul play. a baseball fan dies not long after a fall from turner field. >> he fell from an upper platform to a secured lot. the fall was approximately 65 feet. >> reporter: police believe the man fell from a balcony such as this one behind the field where the braveses and phillies were in a nearly two-hour rain delay. police say it's too early to tell if alcohol played a factor in what they say appears to be an accident. >> i'm not sure who was here. there are several witnesses. >> reporter: atlanta police say the man landed in a secure

parking area. he was taken to a local hospital where he later died. a similar death happened during a college football game last year at the georgia dome, home to the atlanta falcons. on august 31st, a 20-year-old tennessee volunteers' fan fell 35 feet and died. monday's death is not the first for major league baseball. in 2011, a texas rangers' fans fell 20 feet going over the balcony trying to catch a ball tossed to him by josh hamilton. the autopsy is being fer formed right now. it could take -- performed right now. it could take eight weeks to complete. back to you. >> thank you. breaking news. a homicide in east palo alto. ktvu channel 2 reporter katie utehs is live at the scene. katie, what are police saying? >> reporter: well, police are still working out the details, trying to figure out when this woman was killed.

we're looking at highway 4, we have some stop-and-go traffic here coming up to pittsburg. but that's improved as well. as we move over to 80 between vallejo and richmond, that traffic has evened out. it's smooth until you get to the el cerrito area. back to the desk. >> all right, sal. this morning, hundreds of city workers in hayward walked off the job starting a three- day strike. ktvu's tara moriarty, joining us live to tell us what's happening now two hours after the strike started. >> reporter: replacement workers just started to show up. you can see they are picketing right here. they've asked folks not to go inside city hall but they have. just a few minutes ago, we noticed a replacement worker pull up in a white van, workers were yelling at her. members of 2010 decided to hit the picket line after negotiations between the union and the city reached an impasse at the bargaining table. 280 workers are striking for

the next three days outside of the animal control center, the department of public works and libraries. workers have been without a contract since april and without a raise since 2010. they blame the city. the city says it is $2.6 million in the red. but union officials say the city underprojected the budget by $5 million this year alone and is taking the money out of the general fund and putting it into other funds. >> sort of like if we were balancing our check books but we were taking out out money to put in the savings and saying we're in the red. that's exactly what the city is doing to have the excuse to push us out on strikes. >> the city has been fair and reasonable. many groups have met our requirements, including our firefighters. we've asked that all groups forgo races for five years. >> reporter: meanwhile, the city has filed state charges claiming this is an illegal strike. those working in 911 dispatch

will remain on the job. live from hayward, i'm tara moriarty, ktvu channel 2 news. >> all right, tara. in about an hour from now, dozens of domestic workers are scheduled to rally outside of san francisco city hall. this is part of a national campaign that domestic workers are calling countdown to dignity. domestic workers nationwide are calling on the u.s. government to mandate better pay and benefits for inhome caregivers. domestic workers want regular rest periods and they want overtime pay. now that they've approved a temporary fix for the new span of the bay bridge, federal officials say there's no reason not to open it by labor day. alex savidge is live to tell us about the fix that could help the span open in -- gosh, in just 20 days. >> reporter: just three weeks from now, we could be back on track for the labor day opening. the opening delayed because cracks were found in the

seismic safety bolts. now the feds are saying they support the idea of opening the new span early while a temporary fix is put in place. the plan is to install metal plates that can shore up stabilizers in the bridge. in the letter sent to the chair oversight committee, the federal highway administration says this fix would provide add quit size mike service until a permanent fix in december. the opening pushed back to at least december after the faulty bolts. now there's another sign that labor day could be a reality. according to a report out, the chp began to sign up employees for around the cloud cover oversim shifts -- for around the clock overtime shifts. i was told that's simply a formality. caltrans will be testing new l.e.d. lights on the eastern span of the bay bridge.

before that happens, they will hold a media briefing. officials will be talking about how this green light from the feds to go ahead with the temperature fix on the bolts could impact opening day. live in morning on treasure island, alex savidge, ktvu channel 2 news. 8:05. a fairfield man accused of drowning a dog in a public bond yesterday morning is facing charges of felony animal cruelty. police say several people saw 21-year-old bryan cavanah hold that dog underwater yesterday morning. he's accused of carrying the dog to the pond in fairfield. investigators say he admitted killing the pit bull/terrier mix. it belonged to his father. he didn't know why he did it. he's being held without bail. a good samaritan has helped a dog recover from a deer attack. now, this is a yellow lab. his name, casper. partially paralyzed in that deer attack. the owner sent us this video of the pool therapy he says helped

casper recover. by the way, he's thanking the woman who allowed casper to use her pool. this morning, bay area hospitals are being warned about a woman pretending to be a nurse. deputies say 29-year-old crystal cook was wearing scrubs and a stethoscope when arrested at santa clara valley medical center in san jose. she even had a fake i.d. hospital officials say cook would not have been able to access critical areas like the emergency room because her badge was not a real key card. but patients are calling for better security. >> one of her claims on facebook that she was part of a pediatric heart transplant procedure which is totally made up. we don't do them here. >> deputies have not said why cook was impersonating a nurse but say her took postings led to her arrest. she has no medical background and there's no immediate evidence she treated parts.

she's been release -- patients. she's been released from jail. the drunk driver accused of killing a girl on her 17-year- old birth is due back in court. kieran brewer faces charges for the deadly accident in stern grove in march. investigators say brewer was behind the wheel of the car that struck and killed the teen. his lawyer said his blood alcohol level was barely above the legal limit when booked into custody. however, prosecutors note the testing was done several hours after the deadly crash. and new this morning -- a tomato truck flipped over, causing this rather slippery situation for drivers. it happened just before 3:00 a.m. on southbound i-80. you can see the huge mess screws had to clean up -- mess crews had to clean up. no word what caused the crash. san francisco police will hold a news conference at 11:00 a.m. at a major ecstasy bust in the ingleside district.

two people are in custody. that bust involves several kilos of the drug. police say they will have the drugs and the drug money on display at that news conference this morning. san francisco's public utilities commission, due to vote today on the city's renewable energy rates. clean power sf was supposed to launch in october. residents of san francisco would be rolled into that program but they could opt out in they want. originally customers would have paid about twice what they currently pay pg&e. city leaders wanted to reduce what customers would pay so the vote has been delayed several times. neighbors opposed to a proposed apartment complex in la fayette spoke out at a city council meeting. >> we believe this huge project is wrong. >> plans for the terraces of la fayette call for 300 luxury apartments to be built across from a high school. developers say the apartments will provide needed options for

welcome back. we're looking at live pictures from east palo alto. there's a homicide investigation happening right now. we've been on this story for the past couple of minutes. they are investigating what happened out there. ktvu's katie utehs is there as well gathering information. we'll hear from her in a couple of minutes. welcome back. i'm dave clark. we'll get to that in a couple of minutes. but first, let's get to the weather and traffic. steve? >> thank you, dave. we have some fog but there's already breaks in it or holes in the fog. not for everyone. but it will burn off sooner. 60s, 70s coast. 80s and low 90s inland. unless you are really far inland. average temperatures. i re-- i would have to dig deep to find the last time all of these were over the forecasted highs but they will be today if everybody comes to fruition. sfo, 73. already sun around san bruno. 84 san jose. and santa rosa at 85 degrees.

a little bit above. 50s and 60s. some temperatures this morning did dip into the low 50s. united states with the low cloud deck settles in, they stop. the wind is nonexistent. seen around port chicago, 20. that's about it. union city, gusts to 20. the fog is a tenuous rope on the coast and already beginning to pull off. high pressure is building in. this system looks like this will sweep in saturday for another cooldown. inland gets the biggest jump. the fog gets chewed up for a couple of days. kind of a warmer pattern into thursday and then another cooler pattern kicks in saturday. fog, sun, warmer. some of that morning cloud deck beginning to erode. some areas getting sunshine that have not seen sun in a long, long time. 90s for those well in the interior. 80s for others. 60s, 70s clothier to the water's -- closer to the water's ege.

this is about typical for this time of year for some. temperatures have coned to average way below average. we're getting near average to slightly above. we'll stay there on thursday and then cool it down friday/saturday. we're looking at the roads getting better as we get to the end of the morning commute. we've seen some improvement this morning, as you drive from milpitas to sunnyvale, although it's still slow in some spots there. the commute on interstate 880 northbound, that's improved a little bit. it's a little slow approaching high street. after that, it's okay. we're looking at the commute at the bay bridge toll plaza, that's much improved. here it is after 8:30. we have a very small delay at the toll plaza. 8:32 now. back to the desk. >> all right, sal. we're still following breaking news out of east palo alto. a homicide that occurred this morning and more investigators are arriving at that scene now. katie utehs is at the scene to tell us what is the latest.

what do you know, katie? >> reporter: well, dave, within the last hour, we've seen many more detectives arrive on scene. they are still being quite mumm about what happened here. we've confirmed it's one female -- excuse me, one female suspect and male suspect who police say pointed them here to this apartment complex behind me in east palo alto at the woodland park apartments, is the name of that complex. let me show you video of detectives that we shot earlier that are here on scene. they tell us they learned of this homicide sometime around 6:00 a.m. at this point, it's unclear how the woman was killed and how long she had been dead. they do tell us that the suspect they have in custody, that male suspect, pointed them to the apartment complex, and they are still waiting for the coroner to arrive. at this point, the forensic lab techs have arrived. they are processing the scene. we're also told that detectives are interviewing neighbors who

are being cooperative. it's unclear how police were notified whether it was neighbors or by the suspect who called 911. within the last few minutes, it appears that family members may have arrived there. there are people here on scene that are hugging each other. there's some tears as well. so, still working to learn more about who this female victim is. we do know the homicide eye cured this morning. police found out about it at 6:00. the public information officer is being called and she'll be able to give us more details. live in east palo alto, katie utehs, ktvu channel 2 news. well, palo alto police are warning drivers about a rash of smash-and-grab car burglaries. palo alto police responded to 70 car break-ins this summer. almost 50 happened in the month of june. many of the break-ins have been in the el camino area and the stanford shopping center.

police say drivers of rental cars should be especially careful because vandals know those drivers leave valuables inside. a 28-year-old butcher working at a market in san anselmo had his right forearm amputated in an accident at work. firefighters say the man was conscious when they arrived about 5:30 yesterday morning afternoon. he was flown to stanford university medical center. it's not clear yet exactly what happened and the accident is being investigated. a fourth grader attacked by a pit bull is scheduled to undergo another operation today. 10-year-old hunter kilborn of martinez is recovering from major injuries he suffered in the attack. the little boy was visiting family, friends in antioch sunday morning, when the pit bull got into the house. the dog then jumped on him and repeatedly bit his cheek, head and arms. surgeons had to reattach his

ear. >> knowing he's gonna have to have many surgery, skin graphs, it's -- it's just a shame. my heart you breaks for him -- my heart breaks for him. i told him i love him and to be strong. he was still in shock. >> it's still not clear who owns the dog. the pit bull has been taken in by animal control officers and will remain quarantined for at least a week. the little boy's mom said she will do everything possible to make sure that dog is euthanized. oakland police are expected to announce today if a woman's body found last friday in vacaville is of that missing oakland woman, sandra coke. coke disappeared more than a week ago. she's an investigator with the federal defenders office, and she was last seen with the man she dated briefly 20 years ago hours before she disappeared. now, police have surveillance video of randy alana putting gas in koch's car. he's a convicted rapist and

robber who is required to wear a gps device as part of his parole. two weeks after she vanished, an arrest warrant was issued for him for failing to participate in the gps monitoring program. the state is not saying when the gps stopped sending signals on his location. the man charged in the deadly stabbing of a hardware worker is due in court this afternoon. the victim, daniel stone, was just starting his shift at the store nine days ago when someone walked in and stabbed him 17 times. agnew was arrested for the killing. they say he was mentally unstable who claimed he was on "a mission from allah." funeral services are set for a fatherrant his 16-month- old son. they were shot to death in an oakland home last week. the memorial and funeral service for the little boy is

on friday. services are open to the public. the boy's mother, the mother of drew jackson, ask asking people don't wear -- is asking people don't wear the color black. drew thomas's funeral is scheduled one week from today. no arrests have been made in the killings. protesters who have camped outside of the historic berkeley post office are getting good news. ktvu's brian flores is in berkeley now, where the building has been given a reprieve even though it may be a brief one. what's going on, brian? >> reporter: well, that's for now, dave. good morning to you. many people with the group citizens to save the berkeley post office received good news recently and have been camped out since last month. the news that the historic building will be spared comes as good news for many. it's a small victory, there say. but they are -- they say. but they are not celebrating. the news is they've agreed to hear tom bates's appeal that it

should be saved. with the hear, the building that's been here since 1914 will at peest be spared for a couple of months until the mayor speaks in front of the commission in september or october. the "chronicle" reports that he has until september 3rd to submit paperwork about why this is the best location to operate. the issue has always been cutting costs and selling post offices, even this one, are needed to keep the post office afloat. the group says the post office means a lot and keeping it here is still a battle. >> it's great to have a central post office and not to have to travel by car to another distant location. i use the post office a lot. i mail packages to family. i'm still an old-fashioned letter-writer. >> we should not change it. why change it? what's the problem? >> reporter: after the hearing, the commission would have 120 days to grant or deny the

appeal. keep in mind there are several groups out here, not just the citizens to save the building, yok pay berkeley, some people are -- occupy berkeley, some people are considering staying here while a decision is made. others say they are going to take it day by day. brian flores, ktvu channel 2 news. >> thank you, brian. cal football player, avery sebastian is recovering from a hard tackle that was so rough, he had to be taken away from program tis in an ambulance -- practice in an ambulance. it happened during a scrimmage. cam says sebastian has -- cal says sebastian has movement in all of his extremities and is expected to be released soon. police in atlanta are investigating the death of a baseball field at turner field. the man was on one of the upper platforms when he fell to a bl -- to a parking lot below. investigators say that's a 65-

foot fall. they believe the fall was an accident. a wildfire in placer county, it has spread to 1200 acres now still burning. the american fire started saturday near forest hill. it's grown 400 acres since this time yesterday. smoke from the fire will be settling in forest hill, auburn and nevada city and the surrounding valley for the next couple of days. this fire is burning in very steep terrain. they are using planes mainly to fight it. two large wildfires are burning in central idaho. the elk complex fire near pine, idaho has burned more than 90,000 acres. it's only 5% contained. there are mandatory evacuations out there but some people are refusing to leave. the further south, the pony complex fire, covers 144,000 acres. it's only 30% contained. firefighters are blaming

lightning for both of those fires, which broke out last thursday. 19 minutes before 9:00. a proposed megamerger involving two huge airlines. why the u.s. government and several states are trying to stop it. nearly 300 workers in hayward have walked off the job today. we'll tell you why they are angry at the city and what they are asking from the public. well, some commutes have become better. others are just getting that last-minute push. we'll tell you where in the south bay you'll see the slowest traffic. already some breaks in the fog bank. we'll talk about warmer temperatures starting to kick in. but how long will it last? ♪

reported sales increased 2/10 in july and june sales were revised. those are both signs that consumers are gaining confidence in home values and stock prices. clothing sales were especially strong as we head into the back- to-school shopping season. j.c. penneys announced that william ackman is resigning. ackman has been pressuring the company to remove the current ceo and chairman. ackman had also demanded the new director with experience -- with experience in the position. the federal government just gave a boost to a plan to open the new eastern span of the bay bridge on labor day, as first scheduled. the federal highway administration signed off on a temporary fix for the cracked seismic safety bolts on the span that could allow for the

labor day opening. in hayward, hundreds of city workers walked off a jo be this morning starting a three- day strike. tara moriarty joining us live to tell us what's happening out there right now, more than two hours after this strike began. good morning, tara. >> reporter: well, over the past hour, replacement workers have been walking up to city hall as well as members of the public. they are asked not to cross the picnic line. we only noticed one man honor the request. reese place -- replacement workers have been driving up this morning and have been greeted by very angry protest es. members of local 1021 decided to walk out after negotiations hit an impasse at the table. 280 workers are striking for the next three days outside of the city's animal control center, the department of public works and libraries. workers have been without a contract since april and without a raise since 2010. they blame the city. >> we can't give any more.

sal. how are things looking in the south bay? >> well, a little slow, westbound 237, nond 101, northbound 880 is getting slow as you approach the valley. you can still see slow traffic on 237. this is the late commute. now there's some good news. some of the east bay commutes have been looking better. so have some of the peninsula commutes. as we look at 101 here, it looks good. 580 is a little bit more even between livermore and dublin. it's moderately heavy. if you are driving to the bay bridge toll plaza, that's cleared out westbound. let's go to steve. >> we have breaks in the fog. low pressure coming in. the basis which were way up there for a while, about 2500 feet now coming down a thousand. already pockets of sun in san francisco. reports coming in. we haven't seen the sun for a while. temperatures will warm -- let's go for it. today we'll go for it and say we'll get it officially. there will be other areas that

will be warmer and maybe cooler. we'll check in at 71 in san francisco. some of the low cloud deck favoring the north bay and parts of the coast. fog, clear, sunny, -- that fog will burn off sooner. 47 up in tahoe. 60 in sacramento. 54 down in monterey. 83 in palm springs and also in las vegas. temperatures will be really warm as that high pressure builds in. for us, tropical moisture is gone. just a little band of it. and a little bit inland. the delta breeze is really nonexistent. yesterday it was up to 20. today it's less than 10. high pressure is here for probably two and a half, three days. i think today we'll keep the temperatures there and then a cooling trend on friday/saturday. morning low clouds, fok. sore -- fog. for some, 80s. for some 70s. most of these temperatures are

near average to above. they've been well below for a long, long type. warmer until thursday and then cooler friday/saturday. new this morning -- a big merger is being challenged. ktvu's pam cook is in our newsroom now and they are saying this deal is bad for consumers. >> yeah. this morning, the u.s. department of justice in six states will try to -- no audio [ [ >> the proposed merger would lessen competition throughout the united states. that could mean higher prices for less service. analysts question whether the new airline to be named american can maintain nine
